Parties & Definitions

These Terms of Sale, Use, and Liability Disclaimer ("Agreement") constitute a legally binding contract between Shaolin Cream ("Company," "we," "us," or "our"), a retailer of culinary nitrous oxide (N2O) products, and you, the individual placing an order or visiting this site ("Customer," "you," or "your").

As used in this Agreement:

• a)"Products" means all culinary-grade N2O chargers, whipped cream chargers, dispensers, accessories, and any other items offered for sale by Shaolin Cream.
• b)"Lawful Culinary Purpose" means the sole intended use of our Products: as a food-grade propellant inside compatible whipped cream dispensers and culinary siphons to produce whipped cream, foams, espumas, and similar food preparations.
• c)"Misuse" means any use of our Products outside of their Lawful Culinary Purpose, including but not limited to inhalation, recreational use, resale for prohibited purposes, or any use that violates applicable law.
• d)"Site" means the website www.shaolincream.com and all associated pages, subdomains, and services.

Intended & Exclusive Use of Products

By completing a purchase, you represent and warrant that you are purchasing our Products exclusively for their Lawful Culinary Purpose. You agree that you will not use, allow, or facilitate the use of our Products for any other purpose, and that you understand such other uses may be dangerous, illegal, and subject to criminal penalties under Washington state law and other applicable laws.

Any representation made at the time of purchase that Products will be used for culinary purposes — when the Customer's actual intent is otherwise — constitutes a material misrepresentation that voids any claim against Shaolin Cream and may constitute fraud.

Age Requirement & Eligibility

You must be 21 years of age or older to purchase from Shaolin Cream. By completing any purchase or by clicking "I Agree" below, you represent and warrant that:

• a)You are at least 21 years of age;
• b)You have the legal right and capacity to enter into this Agreement;
• c)You will not purchase our Products on behalf of any person under the age of 21;
• d)You will not transfer, gift, resell, or otherwise provide our Products to any person under the age of 21;
• e)You understand that providing false age information to obtain our Products may constitute a violation of state and local law.

Shaolin Cream reserves the right to require age verification at any point before or after a sale and to refuse or cancel any sale where age verification cannot be confirmed.

Disclaimer of Liability for Product Misuse

Without limiting the generality of the foregoing, Shaolin Cream shall not be liable for:

• a)Any injury, illness, disability, or death resulting from inhalation of nitrous oxide or any other Misuse of our Products;
• b)Any hypoxia, oxygen deprivation, asphyxiation, or respiratory event caused by Misuse;
• c)Any cryogenic burns, frostbite, or tissue damage caused by direct contact with pressurized gas outside of proper culinary equipment;
• d)Any neurological damage, including vitamin B12 depletion or spinal cord damage, resulting from repeated inhalation or exposure;
• e)Any criminal fines, penalties, arrest, prosecution, or incarceration resulting from the Customer's illegal use, distribution, or possession of our Products;
• f)Any harm caused to third parties by the Customer's actions, including providing our Products to minors or individuals who engage in Misuse;
• g)Any property damage, accidents, or incidents arising from improper storage, handling, or use of pressurized chargers;
• h)Any civil or criminal liability incurred by the Customer as a result of violations of Washington state law, federal law, or any other applicable statute or regulation.

You acknowledge that nitrous oxide, when misused, carries serious and well-documented risks of bodily harm, death, and criminal liability, and that you are solely responsible for any consequences arising from your actions with our Products.

Prohibited Uses & Customer Responsibilities

The following uses of our Products are expressly prohibited by this Agreement and may also constitute violations of applicable law:

• 1.Inhaling, huffing, or otherwise using nitrous oxide for any intoxicating, euphoric, or mind-altering purpose;
• 2.Using nitrous oxide outside of a properly rated, food-safe whipped cream dispenser or culinary siphon;
• 3.Discharging chargers directly toward the face, mouth, throat, or body of any person;
• 4.Reselling our Products or providing them to any third party with knowledge or reasonable belief that the recipient will misuse them;
• 5.Providing our Products to any person under 21 years of age;
• 6.Using our Products in a motor vehicle in a manner inconsistent with lawful culinary use;
• 7.Purchasing our Products with the intent to circumvent, evade, or undermine any restriction under Washington state law (including ESHB 2532) or any other applicable law;
• 8.Any other use that violates federal, state, or local law.

Customers who engage in or facilitate any prohibited use bear sole and full responsibility for all resulting consequences, including civil and criminal liability. Shaolin Cream reserves the right to report suspected illegal activity to appropriate law enforcement authorities.

Indemnification

You agree to defend, indemnify, and hold harmless Shaolin Cream, its owners, employees, agents, affiliates, and successors (collectively, "Indemnified Parties") from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• a)Your Misuse of our Products or violation of this Agreement;
• b)Any false representation made by you in connection with a purchase, including false age representation;
• c)Your violation of any applicable law, regulation, or ordinance;
• d)Any harm caused to a third party resulting from your actions with our Products;
• e)Any claim by a governmental authority related to your unlawful use or distribution of our Products.

This indemnification obligation shall survive the termination or expiration of this Agreement and any purchase transaction.

Washington State Legal Compliance

You acknowledge and agree that:

• a)You are familiar with Washington state law governing nitrous oxide, including ESHB 2532 and RCW Chapter 9.47A;
• b)You understand that inhalation of nitrous oxide for any intoxicating purpose is a misdemeanor offense in Washington state punishable by up to 90 days in jail and/or a $1,000 fine;
• c)You understand that selling or distributing nitrous oxide outside of exempted purposes is a gross misdemeanor in Washington state punishable by up to 364 days in jail and/or a $5,000 fine;
• d)Compliance with all applicable laws is your sole responsibility;
• e)Shaolin Cream's sale to you for a lawful culinary purpose does not insulate you from prosecution if you subsequently misuse the Products.

Disclaimer of Warranties

Our Products are sold "as is" for their stated culinary purpose. To the maximum extent permitted by applicable law, Shaolin Cream expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our Products are suitable for any use other than their stated Lawful Culinary Purpose, and we make no representation that they are safe or legal for any other use under any circumstance.

Shaolin Cream makes no warranty regarding the outcome of any culinary application or recipe. Results may vary depending on equipment, technique, and ingredient quality.

Limitation of Liability

To the maximum extent permitted by law, in no event shall Shaolin Cream be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages of any kind, including but not limited to loss of life, bodily injury, loss of income, loss of revenue, loss of data, or loss of business opportunity, even if Shaolin Cream has been advised of the possibility of such damages.

In all cases, Shaolin Cream's total cumulative liability to you for any claim arising out of or relating to this Agreement or any purchase shall not exceed the amount you paid for the specific Product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington state, and you hereby consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to first contact Shaolin Cream in writing and provide a reasonable opportunity (no fewer than 30 days) to resolve the dispute informally.

Modifications to This Agreement

Shaolin Cream reserves the right to update, modify, or replace any part of this Agreement at any time. Changes will be posted to this page with an updated effective date. Your continued use of our Site or purchase of our Products following any modification constitutes your acceptance of the revised terms. It is your responsibility to review this Agreement periodically.

Changes required by new or amended Washington state law or other applicable law may take effect immediately upon posting without prior notice.
